Direction issued by the Commission These proceedings shall be read in continuation of the earlier proceedings of the Commission dated 5.10.2011. On 5.10.2011 the Commission observed and ordered: Let a copy of the complaint filed by Sh. Lenin Raghuvanshi along with the affidavit be sent to the District Magistrate, Varanasi with the direction to cause an enquiry by an officer subordinate to him under the Bonded Labour System (Abolition) Act, 1976and submit report within six weeks. Pursuant to the directions of the Commission a letter was issued to District Magistrate, Varanasi on 14.10.2011 but no report submitted. Let a final reminder be issued to District Magistrate, Varanasi to submit report within six weeks failing which Commission shall be compelled to initiate proceedings under Section 13 of the Protection of Human Rights Act 1993.

Let the complaint be transferred to the Uttar Pradesh State Human Rights Commission u/s 13 (6) of the Protection of Human Rights Act, 1993, as amended by the Protection of Human Rights (Amendment) Act, 2006, for disposal in accordance with the provisions of the Act. 2. In the meantime, notice be issued to the concerned SP/SSPs,requiring him to conduct inquiry and submit report as the allegations contained in the complaint appear to be serious in nature. The report should positively be submitted to the Uttar Pradesh State Human Rights Commission within four weeks.
