NHRC recommends rupees fifty thousand monetary relief to a Delhi school boy victim of corporal punishment

New Delhi, March 21st, 2012

The National Human Rights Commission has recommended monetary relief of rupees fifty thousand to a school boy victim of corporal punishment by his teacher in a Delhi school. The Commission took this decision on the basis of a complaint dated 22nd April, 2010 forwarding a newspaper clipping alleging that a 12 year old boy, Arjun Chandra, was beaten by his mathematics teacher on the 10th December, 2009. The boy suffered injuries on his left shoulder and the elbow for which he was operated upon.

The Commission on the basis of reports and material found that the allegations were correct and the teacher was booked under Section 323 IPC and 23 JJ Act by police under Ambedkar Nagar police station. A charge-sheet was also filed in the court of Metropolitan Magistrate Saket.

However, despite repeated reminders, the Secretary, Department of Education, Government of NCT of Delhi did not respond to the show cause notice of the Commission for payment of monetary relief to the boy whose human rights were violated.

Finally, the Commission has recommended that the Government of NCT of Delhi pay rupees fifty thousand as monetary relief to the victim Arjun Chandra. The Chief Secretary of Government of NCT of Delhi has been directed to send the proof of payment. The next date for hearing of the matter in the Commission has been fixed for 5th April, 2012.
