Sir/Madam,
With reference to your letter no. dated , I am directed to say that the matter was considered by the Commission on 21/09/2012 and the Commission has directed as follows:
Dr. Lenin from Daulatpur, Varanasi, U.P. forwarded a news item in which it was mentioned that one Sanjay Yadav committed suicide due to torture by the owner of the factory. Now the Administration of District Varanasi is trying to persuade the next of kin of the deceased to receive a cheque of Rs. 20,000/-. He sought intervention of the Commission. The Commission took cognizance on 20.9.2011 and issued notice to concerned authority calling for report within four weeks. Pursuant to the direction of the Commission, Superintendent of Police (Rural)/Nodal Officer, Varanasi, U.P. on 26.6.2012 forwarded the report of the Circle Officer, Varanasi who after enquiry concluded that Sanjay Yadav was working in a factory. One of the other employees, Vijay Kumar Maurya had committed a criminal breach of trust and consequently, a case u/s 406 IPC was registered against him and after investigation chargesheet was submitted to court. The accused Vijay Kumar Maurya was arrested and sent to jail. It was further submitted that Sanjay Yadav was never tortured by police. He was called to the Police Station three times but questioning but not tortured. From the enquiry, the allegation of police torture could not be substantiated. Before proceeding further, let the copy of report dated 26.6.2012 be sent to the complainant for his comments within six weeks.
2. It is therefore, requested that the additional / complete report as directed by the Commission in the matter be sent latest by 14/11/2012 for further consideration by the Commission.
