PRESS RELEASE
On NHRC recommendations Puducherry Government pays rupees three lakhs as monetary relief in a case of death in judicial custody
New Delhi, March 16th, 2012

In compliance with the NHRC recommendations the Government of Puducherry has paid rupees three lakhs as monetary relief to the wife of an under-trial prisoner, Silvaraj alias Siva, who died in Central Prison, Kalapet, Puducherry on the 15th August, 2009, just a day after he was admitted to jail.

The Commission after consideration of various reports including post-mortem and magisterial inquiry report found that Silvaraj that he was admitted to the prison around 05:45 PM on the 14th August, 2009 and was found dead the next morning. He had various serious injuries which led to his death.

The magisterial inquiry had concluded that there were grounds for suspecting foul play and the apparent cause of death was homicide. The inquiry Magistrate also said that the jail administration appeared to have had failed to effectively discharge their duties and therefore he recommended for a separate inquiry in the matter. The inquest report also recorded the statement of his wife who said that he was normal when she met him in Thavalakupam police station and he was not suffering from any serious disease.

The compliance report also said that chargesheets have been filed against the five prison inmates who were found guilty of assaulting Silvaraj to death. The amendments in recruitment rules have been made to fill the vacancies in the prison which was found to be having an acute shortage of man power.
